TERMS & CONDITIONS

By engaging in any rental, gear demo activity, the customer agrees to the following terms and conditions.

SIGN CONTRACTS: Customers must read and sign the rental agreement contract before using any equipment. The contract may include a waiver of liability, that waives certain rights, and puts the sole responsibility back on the renter.

HEALTH & FITNESS: Customers must be fit and healthy for the proposed activity. All participants or users of rental gear must have appropriate swimming abilities.

SKILL LEVEL: And they must be trained and skilled to the appropriate level for the activity. Customers/renters/users should not attempt to operate any equipment that they are not trained, skilled or qualified to use.

THIRD PARTY USE: Only persons who have signed the rental contracts and waivers, may use the gear. Renters should not lend their equipment to anyone who is not trained or skilled to use the equipment. Anyone intending to do instruction or teach a person using the rental gear, must be qualified to do so, and should have professional liability insurance appropriate to their training activity.

GEAR SUITABILITY: Customers are responsible for the selection of gear suitable to their abilities. Any recommendations or suggestions by our staff, are merely general product information, that makes no warranty as to the suitability or safety of any equipment. The decision to rent or not rent is solely the responsibility of the renter. We do not have any control over how or when you use the equipment, and the renter is totally responsible for damage, injury or liability arising from the use or misuse of the rental gear.

LOCAL RULES & WEATHER: Customers agree to follow the local rules and guidelines, including the sailing right of way rules, "rules of the road", and to always exercise discretion and caution when deciding when, where and how to ride. Customers should make themselves aware of prevailing weather conditions, and to stay informed about wind and weather related warnings, or advisories.

BEFORE DECIDING TO ENGAGE IN ANY water related activity. It is strongly recommended that renters review the terms of their health/medical insurance in case of a sports related injury. Visitors should review the terms of their travel insurance, which may not cover the use of certain types of rental equipment. Renters should be aware of the coverage and limits to their personal liability insurance coverage in the event of an injury to another person or property.

DEPOSITS: Customers are responsible for FULL REPLACEMENT VALUE and/or REPAIR COSTS of any broken and/or lost gear. Please enquire as to the replacement value of any rented item before taking it.

RAIN CHECK: Any unused rental due to bad weather can be used at a later date, up to one year after the initial reservation dates. Customers can also exchange their unused rental fees in store credit.

DEMO GEAR: Demo Gear is available to customers wishing to test gear before they buy. Demo Rates are the same as Rental Rates. Your first day's rental can be applied to the purchase of New equipment of the same type. When new gear is used for the demo, it will be the same gear available for purchase as new. Used gear can usually be demo/tested by arrangement. No demos/tests are available on consignment equipment. Customers are 100 percent responsible for lost, stolen or broken gear.

KITE GEAR: Kitesurfing Gear can be demoed during a lesson by arrangement. Please set this up ahead of time. Kiters will be only allowed to use gear appropriate to their kiteboarding level, and wind conditions. For advanced riding, proof of ability will be required, for example IKO Kiteboarder certification Card L3, and proof personal rider insurance is recommended. Kiters are responsible for loss or damage to equipment during lessons and demos. Renters will be asked for a full value deposit for the replacement value of the rented equipment.
